The Ministry of the Interior claims that they have no contract in place with EBE - refer to the article at Novinky.cz:
However, EBE does have a contract with the Ministry of the Interior, dating all the way back to 2003; they also have other contracts with IBM that transfer the license to use EBE´s solution and, hence, even the obligation to observe them, to the Ministry of the Interior. It is true that the Ministry of the Interior has no contract in place for the ongoing operation of the Public Administration Portal; nevertheless, they use the services and do not pay for them.
Based on EBE´s rights arising from the
aforementioned contracts, in 2007 the Ministry of the Interior even had to cancel another contract that they had made with Telefónica O2.
Based on that contract, Telefónica O2 was to rewrite the existing Public Administration Portal code and, thus, basically plagiarize it in the very part that was developed by EBE.
If, on the basis of EBE´s rights, the Ministry of the Interior has once already cancelled its contract with a third party due to its nullity from the very beginning - ex lege, it means that the Ministry has undoubtedly recognized EBE´s rights in this respect. Therefore, EBE feels that such statements made by the staff of the Ministry of the Interior cannot be anything else but their ignorance or ill will, which is however misleading for the very management of the Ministry of the Interior.
With their allegation that they have no contract in place with EBE, the Ministry of the Interior just proves that they have been involved in the unauthorized use of EBE´s applications.
